Nintendo Faces Class-Action Lawsuit Over Tariff Refund Dispute

A recent lawsuit has been filed against Nintendo by two of its customers, who allege that the company is attempting to benefit from both increased prices for consumers and compensation from the US government. This lawsuit comes after Nintendo of America filed its own lawsuit against the US government last month, seeking a refund of tariffs paid, along with interest, due to what it claims were unlawful trade measures. The customers' lawsuit, filed in Washington state, accuses Nintendo of potentially receiving double compensation for the same tariff payments - once through higher prices paid by consumers and again through refunds from the federal government, including interest. The plaintiffs, Gregory Hoffert and Prashant Sharan, represent American consumers who purchased Nintendo products affected by tariffs between February 1 and February 24, 2026. Nintendo is among over 1,000 companies, including FedEx and Costco, that are suing the US government over tariffs. These lawsuits follow a Supreme Court decision to overturn most of the global tariffs imposed by former US President Donald Trump, which took effect last April as Nintendo prepared to launch the Switch 2 in June.
