Nintendo Secures Court Victory Against Streamer for Pirating Games
Nintendo has emerged victorious in a lawsuit against a streamer who illegally livestreamed pirated games before their official release. The lawsuit, filed last November, targeted streamer Jesse 'Every Game Guru' Keighin, who was accused of streaming leaked games on over 50 occasions since 2022, including unreleased titles such as Mario & Luigi: Brothership and The Legend of Zelda: Echoes of Wisdom. Despite receiving numerous takedown notices from Nintendo on platforms like YouTube, Twitch, and Kick, Keighin allegedly continued to stream pirated games, utilizing unlawfully modified consoles and emulators, and shared links to emulators like Yuzu and Ryujinx with his viewers. Keighin, who failed to appear in court, has been ordered to pay $17,500 in damages. According to Nintendo, Keighin's actions resulted in 'millions of dollars' in lost game sales due to the 'trafficking' of illegal 'circumvention devices.' The court granted an injunction against Keighin but denied Nintendo's request to extend the injunction to anonymous 'third parties' and refused to order the destruction of devices used by Keighin, citing a lack of clarity and reasonableness in the request. This ruling comes on the heels of another lawsuit filed by Nintendo of America against Redditor James C. Williams, seeking $4.5 million in damages for allegedly pirating Switch games and promoting their distribution online.
