Nintendo Takes Legal Action Against Third-Party Accessory Maker Over Alleged Trademark Infringement and Deceptive Advertising

A lawsuit has been filed by Nintendo against a third-party accessories manufacturer, alleging trademark infringement, unfair competition, and false advertising. According to court documents filed in California, the lawsuit targets Genki, which showcased a mock-up of the Switch 2 console in January 2025, prior to Nintendo's official launch. Nintendo's lawyers argue that Genki engaged in a deliberate campaign to capitalize on public interest in the next-generation console, advertising unauthorized access to the unreleased Nintendo Switch 2 and claiming compatibility with the console. Nintendo disputes these claims, stating that compatibility would be impossible without access to the console, and alleges that Genki either doesn't possess a genuine console or obtained one unlawfully. The company is seeking a court order to stop Genki from using its copyrighted marks, making false representations, and to destroy any infringing products or marketing materials. Nintendo also seeks damages, which it suggests should be determined by an audit of Genki's profits. In response, Genki stated that it is taking the lawsuit seriously and working with legal counsel to respond thoughtfully, emphasizing its commitment to creating innovative gaming accessories and standing by the quality and originality of its products.
