Lead Singer of Crush 40 Sues Sega of America Over Copyright Infringement

A lawsuit has been filed against Sega of America by Johnny Gioeli, a key contributor to the company's music library as the lead singer of Crush 40. The dispute centers around the song 'Live & Learn', which served as the main theme for the 2001 Dreamcast game Sonic Adventure 2. According to reports, Gioeli claims he independently composed, recorded, and produced the song, and is now seeking damages for its unauthorized use outside of the original game. The song has appeared in various titles, including Super Smash Bros games featuring Sonic and Sega's Yakuza series, as well as Capcom's Monster Hunter Rise. Gioeli argues that Sega's use of the song constitutes a breach of contract and is requesting the court to clarify the ownership rights of the song. Although he acknowledges the possibility of joint ownership with Sega, Gioeli asserts that Sega's rights are restricted to the song's lyrics. This development marks a departure from the typical collaborative dynamic between Crush 40 and Sega, which has spanned 23 years and numerous Sonic game soundtracks, often with explicit agreements regarding ownership and master recordings.
