Nintendo Takes Legal Action Against Streamer for Prematurely Broadcasting Unreleased Games

Nintendo has initiated a lawsuit against a streamer, Jesse 'Every Game Guru' Keighin, for broadcasting gameplay of ten unreleased titles. The lawsuit, filed in the US District Court for the District of Colorado, claims Keighin obtained and streamed leaked games over 50 times since 2022, including recent titles such as Mario & Luigi: Brothership and The Legend of Zelda: Echoes of Wisdom. Despite receiving multiple takedown notices, Keighin allegedly continued to stream copyrighted content on platforms like YouTube, Twitch, and Kick, resulting in the shutdown of his channels due to copyright strikes. Nintendo also accuses Keighin of using modified consoles and emulators to play the leaked games and sharing emulator links with his audience. The company is seeking $152,500 in damages for copyright violations and additional compensation for 'actual damages' to be determined at trial. Furthermore, Nintendo is requesting the seizure and destruction of emulators and devices in Keighin's possession. A Nintendo spokesperson stated that the company is committed to protecting the intellectual property rights of game developers and publishers. This lawsuit is part of Nintendo's ongoing efforts to combat emulator usage, following settlements and developer cease-and-desist actions earlier this year.
