Nintendo Takes Legal Action Against Two Alleged Switch Pirates

Nintendo of America has filed lawsuits against two individuals accused of copyright infringement by selling and trading 'circumvention devices'. The lawsuits, filed against Ryan Michael Daly and James C. Williams, also known as 'Archbox', allege that the defendants have engaged in trafficking of circumvention devices, copyright infringement, breach of contract, and interference with contract. According to Nintendo, the defendants' actions have caused 'substantial and irreparable harm' to the company. The lawsuit claims that Daly's website, Modded Hardware, has sold modded consoles, pirated games, and mod chips, while Williams has been accused of being a leading moderator of the SwitchPirates Reddit community. Nintendo alleges that both defendants were aware that their conduct was unlawful and infringed on the company's intellectual property rights. The company had previously issued cease and desist notices to both defendants in March 2024.
