Hutch Games Fined for Failing to Disclose Loot Box Information
The Advertising Standards Authority in the UK has upheld complaints against Hutch Games regarding their failure to disclose loot box information in the ads for two of their mobile games, F1 Clash: Car Racing Manager and Rebel Racing. The regulator found that the ads were misleading because they did not mention the presence of paid loot boxes in the games. Hutch Games had argued that disclosure was not necessary because players could progress through the game without spending money. However, the ASA countered that product listings on app stores are considered important information for consumers when deciding whether to download a game, particularly for those who may be vulnerable to loot box mechanics. As a result, Hutch Games must now clearly indicate when their games contain paid loot boxes. The complaint was brought to the ASA's attention by Leon Xiao, a researcher who has been studying loot box practices. Xiao expressed satisfaction with the outcome but noted that addressing the issue on a case-by-case basis is not a viable solution for the widespread problem of non-compliance with loot box disclosure rules. He emphasized the need for trade bodies and platforms like Apple and Google to take a more active role in ensuring that game developers comply with the law.
