Law Firm Investigates Potential False Advertising Claim Against Activision Blizzard
A law firm specializing in class-action lawsuits is exploring a potential case against Activision Blizzard, alleging false advertising in relation to Diablo Immortal. Migliaccio & Rathod LLP claims that the 'Blessing of the Worthy' legendary gem undergoes detrimental changes as it levels up, constituting a deceptive practice. The firm notes that at level two, the gem has a chance to deal damage equivalent to the player's maximum health when injured, but at level three, this switches to damage equal to the player's current health. Furthermore, the gem is available in bundles that can exceed $100. Instead of offering refunds or compensation, Blizzard plans to update the item's text description to reflect its actual effect at level three. This approach, the firm argues, is essentially a bait-and-switch tactic, as players purchase an item based on its advertised effect, only to receive something different. Migliaccio & Rathod LLP has expressed gratitude to the Communication Workers of America union for bringing this matter to their attention. The CWA and Activision Blizzard have been at odds in recent years, with the union organizing QA staff at Raven Software and Blizzard Albany despite the publisher's objections. Activision Blizzard's efforts to prevent unionization have been contentious, including alleged illegal threats to workers discussing wages and working conditions, as well as enforcing a social media policy that violates employee rights. Recently, the CWA secured enough signed union cards from staff at Blizzard's Proletariat Studios to form a studio-wide union, but Activision Blizzard refuses to recognize the union, instead pushing for a formal vote overseen by the National Labor Relations Board.
